Depending on the Product ordered and the delivery destination, production may take place at different facilities around the world to help reduce delivery times and improve fulfilment efficiency.

Because our Products are made to order, availability, manufacturing methods and fulfilment arrangements may change from time to time.

Our artwork may not be used to create derivative works, AI training datasets, machine learning models, NFTs, or products for resale without our prior written permission.

Unlike traditional retailers, many of our Products are created only after you place an Order.

This Made-to-Order approach allows us to offer original designs while helping reduce unnecessary overproduction and excess inventory.

Although production may take a little longer than purchasing mass-produced products, every item is created specifically for you.

We believe great products are worth the wait.

SECTION 10 – PRODUCT INFORMATION

We make every reasonable effort to ensure Product descriptions, images and specifications are accurate.

However, Products, collections, colours, materials, availability and specifications may change from time to time without notice.

We may introduce, discontinue or modify Products, collections or services from time to time.

SECTION 11 - MADE-TO-ORDER PRODUCTS

Many of our Products are individually manufactured after your Order is placed.

Production generally begins shortly after your Order has been accepted.

For this reason, changes or cancellations may not be possible once production has commenced.

Production timeframes displayed on our Website are estimates only and may vary depending on demand, product type, seasonal workloads and manufacturing capacity.

SECTION 12 – PRODUCT IMAGES, COLOURS AND MANUFACTURING VARIATIONS

We make every reasonable effort to display Products accurately.

However, you acknowledge that:

  • colours may appear differently between screens and printed Products;
  • lighting and photography may influence the appearance of Product images;
  • print placement may vary slightly;
  • garment measurements may vary within normal manufacturing tolerances;
  • embroidery positioning may vary slightly; and
  • natural variations in fabrics and materials may occur.

These characteristics are a normal part of the manufacturing process and are not considered defects.

SECTION 13 - SIZING

Size guides are provided to assist you in selecting the appropriate size.

Before placing an Order, you are responsible for reviewing the applicable size guide.

Measurements are approximate and may vary within standard manufacturing tolerances.

If you are unsure which size to purchase, we encourage you to contact us before placing your Order.

SECTION 14 – PRICING AND PAYMENTS

All prices displayed on our Website are shown in the applicable currency available during checkout.

Prices may change from time to time.

Shipping costs, taxes, customs duties and import charges are calculated separately unless otherwise stated.

Payment must be successfully authorised before production of your Order can begin.

Payments are securely processed through trusted third-party payment providers.

Funky Monkey Lab does not store your complete payment card details.

SECTION 15 – ORDERS

When you place an Order, you will receive an email acknowledging receipt of your Order.

This acknowledgement does not constitute acceptance of your Order.

Your Order is accepted once production begins or we otherwise confirm acceptance.

Before completing checkout, you are responsible for ensuring that:

  • your shipping address is correct;
  • your billing information is accurate;
  • your selected Products, colours and sizes are correct; and
  • any personalisation details provided are accurate.

Because many Products are Made-to-Order, requests to change or cancel an Order cannot be guaranteed once production has commenced.

SECTION 16 – SHIPPING AND DELIVERY

Production and Delivery

Many of our Products are Made-to-Order and are manufactured specifically after your Order has been accepted.

Depending on the Product ordered and the delivery destination, your Order may be produced at different production facilities around the world.

Production and delivery estimates displayed on our Website are provided as guides only and are not guaranteed.

Delivery times may vary depending on:

  • production demand;
  • shipping destination;
  • customs processing;
  • courier services;
  • weather events;
  • public holidays; and
  • circumstances beyond our reasonable control.

While we work with trusted Fulfilment Partners and shipping providers, we cannot guarantee delivery dates.

SECTION 17 – SPLIT SHIPMENTS

Where practical, Products within the same Order may be manufactured or shipped from different production facilities.

As a result, your Order may arrive in multiple shipments on different dates.

Where available, separate tracking information will be provided for each shipment.

SECTION 18 – INTERNATIONAL ORDERS

Funky Monkey Lab proudly ships to customers around the world.

International Orders may be subject to customs inspections, import duties, taxes, VAT or other government charges imposed by your destination country.

Unless otherwise stated during checkout, these charges are your responsibility.

You are also responsible for ensuring that the Products you order comply with the import laws applicable in your country.

SECTION 19 - TRACKING

Where tracking is available, you will receive tracking information once your Order has been dispatched.

Tracking updates are provided by the shipping carrier.

Although we will assist where possible, we cannot control the accuracy or frequency of updates provided by third-party carriers.

SECTION 20 – INCORRECT SHIPPING INFORMATION

It is your responsibility to provide accurate shipping information when placing your Order.

If incorrect information is supplied, this may result in delays, additional shipping costs or the return of your parcel.

While we will always do our best to assist, changes cannot be guaranteed once production or shipping has commenced.

If something isn't right, we'll work with you to find a fair and reasonable solution in accordance with these Terms and applicable consumer protection laws.

SECTION 22 – CHANGE OF MIND

Because many of our Products are Made-to-Order, we generally cannot accept returns or provide refunds where you:

  • change your mind;
  • order the wrong size;
  • choose the wrong colour;
  • provide an incorrect shipping address; or
  • no longer require the Product after production has commenced.

Nothing in this section limits any rights available under applicable consumer protection laws.

SECTION 23 – DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

If your Product arrives damaged, defective or significantly different from what you ordered due to our error, please contact us as soon as reasonably practicable.

To help us investigate, we may ask for:

  • your Order number;
  • photographs of the Product;
  • photographs of the packaging; and
  • a description of the issue.

Where a fault or error is confirmed, we will provide an appropriate remedy, which may include a replacement, repair or refund, depending on the circumstances and applicable law.

SECTION 24 – MANUFACTURING VARIATIONS

Minor variations are a normal part of Made-to-Order manufacturing.

These may include slight differences in:

  • print placement;
  • embroidery positioning;
  • garment measurements;
  • fabric texture; and
  • colour reproduction.

These variations are not considered manufacturing defects.

SECTION 25 – REFUNDS AND REPLACEMENTS

Approved refunds will generally be processed using your original payment method.

Where appropriate, we may offer a replacement Product instead of a refund.

Shipping charges are generally non-refundable unless required by law or where the issue resulted from our error.

SECTION 26 – YOUR CONSUMER RIGHTS

Nothing in these Terms excludes, restricts or limits any rights, guarantees or remedies that cannot legally be excluded under the consumer protection laws applicable to you in your country or region.

SECTION 27 – THIRD-PARTY SERVICES

To operate our business, Funky Monkey Lab works with trusted third-party providers including manufacturing partners, fulfilment partners, shipping providers, payment processors, technology platforms and other service providers.

These providers help us produce, process, deliver and support your Orders. While we carefully select our partners, they operate independently under their own terms and privacy policies.

While we will always do our best to assist, we are not responsible for matters outside our reasonable control arising from the independent operation of those third-party services.

SECTION 28 – WEBSITE AVAILABILITY

We aim to keep our Website available at all times.

However, access may occasionally be interrupted due to maintenance, software updates, technical issues or circumstances beyond our reasonable control.

We may modify, suspend or discontinue any part of the Website where reasonably necessary.

Where Digital Products are purchased or downloaded, you are granted a personal, non-exclusive, non-transferable licence to use those Digital Products for your own personal, non-commercial use.

The creation, sale or distribution of counterfeit products or unauthorised reproductions of our designs may result in legal action.

Our Website, Products and services are provided on an "as available" basis to the fullest extent permitted by law.

While we make reasonable efforts to ensure information published on our Website is accurate, we do not warrant that all content will always be complete, current or error-free.
